First Amendment

Association’s Name and Membership Clause

[Formally Adopted on 15 April 2000]
Pursuant to the decision it took at its 19th Regular Meeting, held in Woodbridge, NJ on 26th February 2000, the Ogbaru USA Association (NJ & NY) hereafter;

"The Association," unanimously decide to henceforth limit its membership to residents of New Jersey and New York, thereby excising Connecticut and Pennsylvania from the Chapter. It is also decided that those residents of Connecticut and Pennsylvania who may wish on an individual basis, to become members of the New Jersey and New York Chapter may do so as external due paying members, and in accordance with the Constitution of the Ogbaru USA National Association. This bylaw amends the pertinent parts of the Association’s MOU.”  

Second Amendment

Title of Association’s Officers And Terms of Office

[Formally Adopted on 21 October 2000]
Pursuant to the decision it took at its 25th Regular Meeting, held in Aberdeen, New Jersey on 21st October, 2000, the Ogbaru USA Association Inc. (NJ & NY) unanimously adopted this bylaw by which it amended and supplemented Article 5 and other pertinent parts of the Association’s MOU to wit:

“Elected Officers of the Association shall be referred to as President, Vice-President, Secretary, Deputy Secretary, Treasurer, Financial Secretary and Provost. The Officers shall be elected by the general membership of the Association at the October meeting of an election year and shall serve a two-year term expiring on 31 December of the second calendar year following their election. A by-election may be held at any time to replace any elected member who resigns or is removed from office by an act of the Association or natural attrition. Any officer so elected shall serve out the remaining term of his or her predecessor. The Association will have an Agent appointed by the Association. The Agent shall serve for a two-year renewable term. The term of office shall correspond with that of the Cabinet.” 

Third Amendment

Sanctions For Failing to Meet Membership Financial Obligations


[Formally Adopted on 17 February 2001]

Pursuant to the decision it took at its 27th Regular Meeting, held in Yonkers, New York on 17th February, 2001, the Ogbaru USA Association Inc. (NJ & NY) unanimously adopted this bylaw by which it amended and supplemented Article 13 and other pertinent parts of the Association’s MOU to wit:

“Members of the Association are obligated to pay their enrolment, annual dues, levies, and fines as stipulated in the MOU in a timely manner. Any member who fails to comply with this provision and therefore, at any time owes the Association a combined sum in excess of $100, would lose the right to participate and vote in meetings or to represent the Association at the National level. A member’s rights and privileges will, however, be fully restored, when payment is made that would bring the outstanding financial obligation to $100 or lower.”

Fourth Amendment

Distressed Members’ Benefit

[Formally Adopted on January/February 2003]
Pursuant to the decision it took at its 39th or 40th Regular Meeting, held in ----, New Jersey on ??th Janurary or ??th February, 2003, the Ogbaru USA Association Inc. unanimously adopted this bylaw by which it further amended and supplemented Article 13 and other pertinent parts of the Association’s MOU to wit:

“ The Association shall have a Distressed Members’ Benefit Fund. The Distressed Members Benefit Fund shall be held in a separate account distinct from the Association’s operational account. The sole purpose of this Fund is to assist any registered member in good standing, who is bereaved. The benefit shall apply only to loss of spouse, child or parent.  In the event that several members are commonly bereaved, there shall be only one payment of the agreed sum, to the family. In the event of bereavement, the beneficiary/beneficiaries shall receive the sum of $2000.00 (two thousand dollars) from the Association. In order, to establish the Fund, The Association agrees to make a one-time transfer of $2,000.00 dollars from the operational account to the Benefit Account.  Thereafter, the Distressed Members’ Benefit Fund shall be serviced through an annual membership contribution of $25.00 (twenty-five dollars), payable with the Annual Dues. The Association may also assess levies as need be to supplement the Fund.

In the event of the death of a close relative of a member other than a spouse, child or parent or the death of an Ogbaruan, who is a non-member of the Ogbaru USA Association, Inc, the Association shall request members to make voluntary contributions towards assisting the family of that individual.”
